AN  ACT  to  amend  the  state  finance law, in relation to establishing
  temporary emergency financial aid to the  city  of  White  Plains  and
  providing for the repeal of such provisions upon expiration thereof

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The state finance law is amended by adding  a  new  section
54-m to read as follows:
  S 54-M. EMERGENCY FINANCIAL AID TO THE CITY OF WHITE PLAINS. 1.  STATE
ASSISTANCE  SHALL  BE  PAID DURING THE STATE FISCAL YEAR ENDING ON MARCH
THIRTY-FIRST, TWO THOUSAND ELEVEN, AND  DURING  THE  STATE  FISCAL  YEAR
ENDING  ON MARCH THIRTY-FIRST, TWO THOUSAND TWELVE, TO THE CITY OF WHITE
PLAINS, IN AN AMOUNT EQUAL TO ONE SIXTEENTH OF ONE PERCENT OF THE  TOTAL
SALES AND COMPENSATING USE TAXES IMPOSED BY SECTIONS ELEVEN HUNDRED FIVE
AND  ELEVEN  HUNDRED TEN OF THE TAX LAW WITHIN THE TERRITORIAL LIMITS OF
THE CITY OF WHITE PLAINS DURING THE PRIOR STATE FISCAL YEAR.
  2. THE MAYOR OF THE CITY OF WHITE PLAINS, IF HE OR SHE DESIRES TO MAKE
APPLICATION FOR STATE AID UNDER THIS SECTION,  SHALL  ANNUALLY  ON  SUCH
DATES  AS  MAY  BE  FIXED  BY  THE COMMISSIONER OF TAXATION AND FINANCE,
SUBMIT TO HIM OR HER THE REQUEST OF SUCH CITY FOR  SUCH  STATE  AID  AND
SHALL  SUPPORT  SUCH  REQUEST WITH SUCH INFORMATION AS SUCH COMMISSIONER
MAY REQUIRE. THE COMMISSIONER OF TAXATION AND  FINANCE  SHALL  PRESCRIBE
THE FORM IN WHICH SUCH INFORMATION SHALL BE SUBMITTED.
  S  2.  This act shall take effect April 1, 2010; provided, however, if
this act shall have become a law after such date it  shall  take  effect
immediately and shall be deemed to have been in full force and effect on
and after April 1, 2010; provided, further, however, that the provisions
of  section  54-m  of  the state finance law, as added by section one of
this act, shall expire and be deemed repealed at the close of the  state
fiscal year ending on March 31, 2012.
