  printed to be committed to the Committee on Rules

AN ACT to amend the penal law, in relation to endangering the welfare of
  a child

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The closing paragraph of section 260.10 of the penal law,
as amended by chapter 447 of the laws of 2010,  is  amended  and  a  new
subdivision 4 is added to read as follows:
  4.  BEING  A PARENT, GUARDIAN OR OTHER PERSON LEGALLY CHARGED WITH THE
CARE OR CUSTODY OF A CHILD LESS THAN TEN YEARS OLD, HE OR SHE  FAILS  TO
REPORT  TO  THE  POLICE  OR  ANY OTHER PROPER AUTHORITY, SUCH CHILD AS A
MISSING PERSON AFTER SUCH CHILD HAS BEEN MISSING FOR A  PERIOD  OF  TIME
EXCEEDING TWENTY-FOUR HOURS.
  Endangering  the  welfare  of  a  child  is  a class [A misdemeanor] E
FELONY.
  S 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
