   printed to be committed to the Committee on Procurement and Contracts
 
 AN ACT to amend the executive law, in relation  to  establishing  a  New
   York  state  child care expansion program within the office of general
   services
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The executive law is amended by adding a new section 204 to
 read as follows:
   §  204.  NEW  YORK  STATE  CHILD  CARE  EXPANSION  PROGRAM. 1. FOR THE
 PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE  THE  FOLLOWING
 MEANINGS:
   (A)  "CHILD DAY CARE CENTER" SHALL HAVE THE SAME MEANING AS DEFINED BY
 SECTION THREE HUNDRED NINETY OF THE SOCIAL SERVICES LAW.
   (B) "STATE AGENCY" MEANS ANY DEPARTMENT, DIVISION, BUREAU, COMMISSION,
 AGENCY, OFFICE, BOARD OR OTHER SUBUNIT  OF  ANY  PUBLIC  AUTHORITY,  THE
 EXECUTIVE, THE JUDICIARY, OR THE LEGISLATURE.
   (C)  "STATE OFFICE" MEANS ANY OFFICE BUILDING OR FACILITY IN THE STATE
 WHEREIN ONE HUNDRED OR MORE EMPLOYEES, IN AGGREGATE, OF A  STATE  AGENCY
 ARE  LOCATED,  WHETHER OR NOT SUCH OFFICE BUILDING OR FACILITY IS OWNED,
 RENTED, OR LEASED BY THE STATE.
   2. THERE SHALL BE CREATED WITHIN THE OFFICE OF GENERAL SERVICES A "NEW
 YORK STATE CHILD CARE EXPANSION PROGRAM". THE PURPOSE  OF  SUCH  PROGRAM
 SHALL  BE TO ASSIST STATE AGENCIES WITH ESTABLISHING A PHYSICAL LOCATION
 WHEREBY EACH STATE OFFICE SHALL ALLOW A PUBLIC OR PRIVATE CHILD DAY CARE
 CENTER TO OPERATE WITHIN SUCH STATE OFFICE. SUCH PROGRAM  SHALL  REQUIRE
 WITHIN THE CONTRACTUAL AGREEMENT WITH A PUBLIC OR PRIVATE CHILD DAY CARE
 CENTER,  AN  ACCEPTANCE  LOTTERY  SYSTEM  WITH FIRST PREFERENCE GIVEN TO
 STATE EMPLOYEES EMPLOYED IN THE SAME STATE OFFICE AS SUCH CHILD DAY CARE
 CENTER, AND ANY REMAINING AVAILABLE SPOTS OFFERED TO THE GENERAL PUBLIC.
   3. EACH STATE OFFICE, WITH ASSISTANCE FROM THE NEW  YORK  STATE  CHILD
 CARE  EXPANSION  PROGRAM,  SHALL  DESIGNATE A ROOM OR ROOMS AS DEDICATED
 CHILD CARE SPACE WHEREBY SUCH STATE  OFFICE  SHALL  ALLOW  A  PUBLIC  OR
 PRIVATE CHILD DAY CARE CENTER TO OPERATE.
