 Introduced by Sen. GOUNARDES -- read twice and ordered printed, and when
   printed to be committed to the Committee on Codes
 
 AN  ACT to amend the penal law, in relation to establishing the crime of
   obstruction of governmental duties at the scene of a crime
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1. The penal law is amended by adding a new section 195.18 to
 read as follows:
 § 195.18 OBSTRUCTION OF GOVERNMENTAL DUTIES AT THE SCENE OF A CRIME.
   1. A PERSON IS GUILTY OF OBSTRUCTION OF  GOVERNMENTAL  DUTIES  AT  THE
 SCENE OF A CRIME WHEN SUCH PERSON ACTS UNDER THE COLOR OF LAW TO PREVENT
 A  POLICE OFFICER FROM ACCESSING THE SCENE OF A CRIME OR ANY EVIDENCE AT
 THE SCENE OF A CRIME.
   2. FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING  TERMS  SHALL  HAVE
 THE FOLLOWING MEANINGS:
   (A)  "SCENE  OF  A  CRIME"  SHALL MEAN A LOCATION OR LOCATIONS WHERE A
 CRIME IS ALLEGED TO HAVE OCCURRED.
   (B) "POLICE OFFICER" SHALL HAVE THE  SAME  MEANING  AS  SUCH  TERM  IS
 DEFINED IN SECTION 1.20 OF THE CRIMINAL PROCEDURE LAW.
   OBSTRUCTION  OF GOVERNMENTAL DUTIES AT THE SCENE OF A CRIME IS A CLASS
 A MISDEMEANOR.
   § 2. This act shall take effect immediately.
