TITLE OF BILL:

An act to amend the administrative code of the city of New York, in
relation to creating a publicly available list of persons who have been
convicted of illegal dumping

 
PURPOSE OR GENERAL IDEA OF BILL:

The purpose of the bill is to increase accountability for the illegal
dumping of trash in public spaces and further deter individuals and
entities from committing such an act. To establish a publicly available
list of individuals and entities convicted of illegal dumping in the
city of New York.

 
SUMMARY OF PROVISIONS:

Section 1 of the bill amends the administrative code of the city of New
York to establish an illegal dumping registry that shall be published on
the Department of Sanitation's public facing website.  Such registry
              

shall include, but not be limited to, the offender's name, the violation
of which the offender was convicted, the nature of the violation, and
the penalty imposed. The offender shall remain on such registry for a
period of three years.

Section 2 of the bill provides the effective date.

 
JUSTIFICATION:

Illegal dumping is an ongoing and unacceptable issue in the city of New
York. The excessive and irresponsible dumping of trash and other miscel-
laneous items onto the streets, including in front of homes, businesses,
and schools, must be addressed and rectified with urgency. Left unre-
solved, this issue will perpetuate an unsanitary, disorderly, and unsafe
environment for the broader community. It is essential that New York
State further acknowledge the prevalence of this issue and implement
additional deterrents to illegal dumping.

This legislation acts as a strong disincentive for illegal dumping by
requiring offenders to remain on a public and widely accessible registry
for a period of three years. The bill also acts as a reinforcement for
the current penalty for such crime by ensuring that the offender
receives a punishment that includes financial rectification and account-
ability. By enhancing transparency, strengthening deterrents for offen-
ders, and holding illegal dumpers accountable, this legislation rein-
forces New York State's commitment to having clean, orderly, and safe
cities for its citizens.
