The following bills were approved in the NYS Senate.  Senator Gallivan's vote is noted for each bill.

S8750 Establishes a fiscal cliff task force to conduct a study on fiscal cliffs in the state's public assistance programs and to make recommendations related thereto.  AYE

S270 COSPONSOR This bill would allow municipalities to alienate certain parklands without receiving authorization from the Legislature for the purpose of renewable energy generating projects. This bill would exempt solar energy projects that are under two megawatts of generating capacity to be installed in the airspace of a vehicle parking lot without the usual authorization of the Legislature. AYE

S1187 Permits local sanitation departments install and use security cameras in order to help enforcement officers identify and fine individuals who have engaged in illegal dumping. AYE 

S8792 CHAPTER AMENDMENT - Excludes food sold to a student purchasing a meal using an approved donation program of funds or food points from sales tax. Amends the underlying chapter by extending the effective date to July 1, 2026. AYE

S4574B Enacts the "PFAS discharge disclosure act"; requires certain SPDES permit holders to conduct PFAS monitoring and disclose the results from such monitoring. AYE

S7551 Establishes the bottle redemption fraud task force to provide the governor and the legislature with information on the fraud, enforcement, and reporting requirements related to the New York state returnable container act. AYE

S518C Requires the inclusion of diversity and inclusion training in the basic training and pre-employment course curricula for state police officers and municipal police officers and sheriffs, members of fire departments and companies, corrections officers, first responders, emergency medical technicians and advanced emergency medical technicians. NAY (Standards should be set by MPTC.)

S4071A This bill amends Public Authorities Law to add a definition of "stormwater" and to include "stormwater" within the meaning of "sewage" in statutes authorizing the New York City Municipal Water Finance Authority, the Albany Municipal Water Finance Authority, the Town of Wilton Water and Sewer Authority, the Alfred, Almond, Hornellsville Sewer Authority, the Buffalo Sewer Authority, the New York State Local Water and Sewer Authority Act, the Rensselaer County Water and Sewer Authority, the Wayne County Water and Sewer Authority, the Cayuga County Water and Sewer Authority, the Livingston County Water and Sewer Authority, the Niagara Falls Public Water Authority, the Nassau County Sewer and Storm Water Finance Authority, and the Environmental Facilities Corporation.  AYE

S5551 Requires certain public hearings held by the New York state urban development corporation to be recorded and such recordings be posted to the corporation's website within forty-eight hours.  AYE

S607B Provides for the licensure of dietitian nutritionists and nutritionists; defines the practice thereof. NOTE - Current law provides only for certificates in dietetics and nutrition. AYE

S4548 Permits dentists to administer vaccinations against human papillomavirus. AYE

S4518 Amends the Workers' Compensation Law section 13- A to provide that certain communications between a claimant's attorney or representative and an injured employee's treating provider or a claimant's medical consultant are not improper influence or an attempt to improperly influence. AYE

S4816 Includes Lyme disease and other tick-borne diseases as occupational diseases for purposes of workers' compensation; clarifies that disability includes disability caused by Lyme disease or other tick-borne diseases; requires insurance coverage of long term medical care for Lyme disease and other tick borne diseases.  AYE

S8759 CHAPTER AMENDMENT - Requires the state office for the aging to publish a "Guide to Actions When Someone Close Dies". amends the underlying chapter by requiring the guide to be published on the NYSOFA website within one year of the bill's effective date. AYE

S8760 CHAPTER AMENDMENT - Requires the modification of restrictive covenants prior to the sale of real property when covenants, conditions and restrictions exist which discriminate on the basis of race, color, religion, sex, sexual orientation, familial status, marital status, disability, national origin, source of income or ancestry.  AYE

S8780 CHAPTER AMENDMENT - Requires manufacturers of kratom products within the state to have a warning label that the product has not been approved by the federal food and drug administration and the products' side effects; prohibits labeling of kratom products as all natural.  AYE

S8793 CHAPTER AMENDMENT - Aligns state and local procurement laws with federal law prohibiting the procurement of certain information and communications technology and electronic parts or products which are determined to pose a risk to state and national security. AYE

S8817 CHAPTER AMENDMENT - Authorizes an insurer to pay a claim for reimbursement made by a provider using a credit card, virtual credit card or electronic funds transfer payment method that imposes on the provider a free or similar charge to process the payment; defines "virtual credit card" as a single-use series of numbers linked to a fixed dollar amount and provided by an insurer to a provider for the purpose of paying a claim for health care services performed by the provider; makes related provisions.  AYE

S240 Amends the Emergency Tenant Protection Act of 1974, adding a new section 5-b, requiring that a Rent Stabilized unit be occupied as a primary residence by a natural person.  AYE

S11 This bill requires every manufacturer or entity that created or advertised performing non-invasive prenatal screenings to include a written notice about the use of such test for screening purposes. AYE

S8835 CHAPTER AMENDMENT - Relates to the medical aid in dying act. Amends the underlying chapter by modifying the effective date, requiring a mental health evaluation for all patients, clarifying conscience objection provisions, requiring a recording of patient requests, adding a waiting period, and strengthening witness conflict-of-interest requirements. NAY

S8809 CHAPTER AMENDMENT - Enacts the "avoiding vexatious overuse of impleading to delay (AVOID) act" which relates to time frames for certain court filings. Amends the underlying chapter by limiting when a third-party summons and complaint may be filed without a court order to no more than 90 days after the subject answer is served, and prohibiting third party summons and complaint filing and service after the note of issue is filed unless there is good cause shown or in the interest of justice. AYE

S373 This is a sunshine bill that would amend the Urban Development Corporation Act, the State Finance Law, the General Municipal Law, and the Economic Development Law to prohibit confidentiality and nondisclosure from inclusion in certain contracts entered into by the state or a municipality.  AYE

S3029 Provides for the licensing of genetic counselors; creates the state board for genetic counseling. AYE

S496 Amends the labor law to require employers to inform employees signing non-disclosure agreements that they retain the right to report to law enforcement, the equal employment opportunity commission, the division of human rights, a local human rights commission or an attorney retained by the employee. AYE

S1012A Prohibits public utilities from using funds or being reimbursed by funds raised from ratepayers for contributions or gifts to political candidates, trade associations, public charities, and lobbyists, and for certain travel, entertainment and educational expenditures. AYE

S1327 Authorizes the Public Service Commission to set standards for payment plans for eligible customers set up by utility companies. Requires utility companies to make available to its residential customers for service provided at the customer's primary residence a payment plan which averages estimated utility costs over a 10 or 12 month period. AYE

S1329 Directs the Public Service Commission (PSC) to adjust each utility corporation's residential fixed charge upon such corporation's filing with the department of an amendment of rate schedules. AYE

S1847 COSPONSOR Requires the public service commission (PSC) to consider the economic impact of utility rates and charges. When deciding whether to approve a rate or charge increase for a utility (gas, electric, waterworks, steam, telegraph/telephone), the PSC would have to determine whether charges are just and reasonable, consideration must be given to the economic impact of such charges upon consumers and the area served by each such utility.  AYE

S1896 Requires certain utilities to adopt the common equity ratio and rate of return on equity authorized by the public service commission. Creates a standard in which settlement negotiations through commission-led adjudication shall take place when it comes to a utility's rate case.  AYE

S5553C Enacts the "rate hike notice act" which requires utilities in the state of New York to provide notice of a proposed rate hike to a customer via text, email and via such customer's monthly billing statement.  AYE

S5593 Provides that subsequent requests for an extension of a suspension period for certain rate, charge or other changes by utilities shall require approval by the public service commission and shall be valid for one month, after which the commission shall review and determine the necessity of a further extension; provides limitations on retroactive rate recovery by utilities. NAY

S7165A  Authorizes the public service commission to consider non-economic loss suffered by consumers, including pain and suffering or mental anguish, when determining penalties against a public utility company, corporation or person or a combination gas and electric corporation. NAY (Too broad.)

S7328A Increases the number of commissioners of the public service commission to eight; requires the commission to have a duty to protect public interest, including ensuring access to utility services for residential and business customers; prohibits commissioners from having been employed within the last two years by an electric, gas, steam, telecommunications, or water utility that is regulated by the commission. NAY

S7693 Provides that gas, electric, or combination gas and electric corporations shall not be permitted to retain revenues derived from their actual return on equity in excess of authorized rates of return on equity. AYE

S8833 CHAPTER AMENDMENT - Ensures that construction and fabrication done off of a public work site for specific use only in a public work project be compensated at the prevailing wage rate. AYE

S8836 CHAPTER AMENDMENT - Prohibits the lease of state forests, reforestation areas, wildlife management areas and unique areas for the purpose of gas and oil production.  AYE

S8886 CHAPTER AMENDMENT - Relates to authorizing and regulating the use of electronic bell jar vending machines; requires responsible placement and operation of electronic bell jar vending machines; allows for geographic considerations for such machine placement. AYE

S555 This bill establishes restrictions on broadcasting of patients. It states that every patient in a health care facility has a right to have privacy in treatment and caring for personal needs, including the broadcasting of a recognizable image or speech of such patient involved in a health care procedure by requiring a health care facility to obtain express written consent used solely for the purpose of the consent to broadcast the image or voice of the patient receiving treatment.  AYE

S8406 OSC DEPARTMENTAL - This bill is to the community bank deposit program. amends the Banking Law at section 87(2) to increase the allowable amount of state deposits for the Community Bank Deposit Program from $20 million to $30 million. AYE

S681 This bill would amend section 201-a of the Labor Law to add a prohibition on mandatory iris and retina scanning of employees to the existing general prohibition on fingerprinting unless otherwise provided by law. AYE

S8812 CHAPTER AMENDMENT - Amends the underlying chapter that directs the Public Service Commission (PSC) to discontinue the requirement that the ratepayer base cover the cost of new natural gas connections (the one hundred foot rule) by adjusting the effective date from immediate to one year after enactment. NAY

S1919 Eliminates sporting license fees for honorably discharged, disabled veterans. AYE

S620C The bill clarifies that corporations organized prior to April 15, 1935, and thereafter that were lawfully practicing engineering or land surveying shall be authorized to practice geology so long as such corporations have at least one officer or director licensed as a professional geologist.  AYE

S1619 COSPONSOR This bill amends a provision of the Education law governing the authority of licensed pharmacists to administer the Covid-19 and influenza tests by expanding the permitted authority of licensed pharmacists to perform tests specifically for RSV, Strep Infection, Hepatitis C, HIV and blood sugar levels. AYE

S2505A Bill establishing educator diversity task force to conduct a comprehensive study on the diversity of educators in NYS and how to improve the same. AYE

S190 This bill would add a new section 7-a to the volunteer firefighters benefit law, to provide for the payment of certain volunteer firefighter death benefits within 90 days of the filing of application to receive such death benefit by the person or persons entitled to such benefit. AYE

S4075A Authorizes the assessor of Richmond county to grant the Silver Lake Foundation Inc. retroactive real property tax exempt status upon an application therefor. AYE

S2040 This bill would require licensed money transmitters to clearly and prominently warn their customers that are requesting the transmissions prior to completing such transmission of funds, regarding the dangers of consumer fraud. NAY (Unnecessary and a burdensome statutory requirement.)

S1514 Empowers the commissioner of labor to issue stop work orders against employers for misclassification of employees as independent contractors or for providing false, incomplete, or misleading information to an insurance company on the number of employees of such employer.  AYE

S1540 Provides that decisions in disciplinary hearings against managerial or confidential state employees will be final and not subject to change or modification by the employer. AYE

S2264 COSPONSOR Requires subsidiaries of the Niagara Frontier transportation authority and their employees to submit all unresolvable contract negotiations to binding arbitration.  AYE

S866 Amends subdivision 7 of section 130.00 (defining terms related to sex offenses) of the penal law to say that "Physically Helpless" means that a person is unconscious or for any other reason physically unable to communicate affirmative consent (as opposed to unwillingness) to an act. AYE

S489 This bill amends the public health law to require that the office of addiction services and supports, in consultation with the department of health, shall develop or utilize existing education materials to be provided to general hospitals to disseminate to individuals with a documented substance use disorder or who appear to have or be at risk for a substance use disorder during discharge planning. AYE

S1731 Renames an office of addiction services and supports scholarship program the "NYS Father Peter Young Memorial Addiction Professionals Scholarship Program"; codifies the purposes of such program as offering financial education assistance to individuals pursuing a bachelor's degree in addiction studies or the education requirements for an office of addiction services and supports credential at Alfred State College, Stony Brook University or Empire State University. AYE

S1239E Enacts the "food safety and chemical disclosure act"; prohibits certain food additives and food color additives; provides that in an action to enforce compliance, the recognition by the federal food and drug administration of any of these substances as safe may not be alleged as a defense; establishes requirements for the reporting of GRAS (generally recognized as safe) substances. AYE
