The following bills were approved in the NYS Senate. Senator Gallivan's vote is noted for each bill.
S1688 Designates the fourth Thursday in March as "Tuskegee Airmen Commemoration Day". AYE
S1514 Empowers the commissioner of labor to issue stop-work orders against employers for misclassification of employees as independent contractors or for providing false, incomplete, or misleading information to an insurance company on the number of employees of such employer. AYE
S524A Establishes the crime of voyeurism in the first and second degree, which shall be a class A and B misdemeanor, respectively. Importantly, this bill exempts firefighters, healthcare professionals and correctional facility personnel. AYE
S707A Changes the requirement of the Department of Health to report on the administration of Managed Long-Term Care (MLTC) plans to legislative leaders and health committee chairs from “biannually” to “annually”. NAY (Unnecessary. Government intrusion in private business.)
S7160 Directs the senior center council to engage in statewide planning of both a programmatic and fiscal nature to ensure the long-term sustainability and viability of senior centers in all areas of the state. AYE
S5563 Amends general municipal law to allow county comptrollers or local equivalent to examine and audit the projects and actions of industrial development agencies and not-for-profit corporations operating within a county. AYE
S6482 Provides that the education requirements to be licensed as a professional geologist may be partially substituted by practical experience; relates to the issuance of an identification card as a geologist in training. AYE
S1015 This bill amends the EPTL to prohibit a caregiver convicted of a crime against a vulnerable elderly person involving elder abuse from being allowed to receive any distributive share in the estate of such vulnerable elderly person, when such vulnerable elderly person died without a will. AYE
S3690A This bill amends the lien laws governing self-storage facilities to allow self-storage occupants to choose, in the occupancy agreement with the facility owner, to be contacted by telephone in the event the owner seeks to enforce a lien on such self-storage unit. AYE (Concerns have been addressed.)
S2091 Establishes standards for the reuse of deconstructed building materials; requires the uniform building code to set standards for the use of solid-sawn lumber in construction and for the grading of used solid-sawn lumber; requires the secretary of state to develop a program for grading reclaimed wood for structural purposes. AYE
S9630 GOVERNOR'S PROGRAM BILL - Provides for emergency appropriation through April 7, 2026 for the support of government. AYE
S9631 GOVERNOR'S PROGRAM BILL - Extends to April 1, 2028 various expiring laws that allow the Department of Motor vehicles to collect revenue from certain fees relating to motor vehicle transactions and the deposit of revenue collected from taxes imposed by Section 183 and 184 of Tax Law and allows revenue in the Dedicated Highway and Bridge Trust Fund to be used for DMV expenses. NAY (Fees too high. Should all be reviewed.)
S8440A Dedicates the bridge located on Interstate 90, designated as Bridge Number 1092839, which crosses over the Hudson River in the cities of Albany and Rensselaer to Sgt Henry Johnson. AYE
S9020C Expands geographical boundaries for residency requirements of correction officers employed by local correction facilities of Rockland and Orange counties. AYE
S6487C Empowers the council on the arts to designate Little Yemen as a cultural district. NOTE - Little Yemen shall be a region in the Bronx. AYE
S2648 Provides that dental insurance coverage shall include coverage for night guards; defines dental night guards; provides that dental night guards shall be covered under Medicaid. NAY (Increased costs.)
S5047 Authorizes an accident and health insurer to offer an incentive or reward program to support wellness, primary and preventative care, population health, care coordination, case management, disease management, mental health and substance use disorder treatment initiatives, evidence-based treatment, or quality and cost containment initiatives. AYE
S1462 This bill creates a home subsidy for Battery Park City residents in an effort to combat the rise in cost of living in Battery Park City. NAY (Unnecessary. Middle-class subsidy.)
S5535 Requires certain documents and forms to be provided in the twelve most common non-English languages spoken by limited English proficient immigrants of five years or less according to the American community survey, as published by the United States census bureau. Further requires the office of language access to inform asylum seekers, refugees and public organizations of an individuals right to request an interpreter in their primary language, in accordance with existing state and federal language access requirements. AYE
D8046A This bill creates a relocation tax credit for businesses moving operations into New York City from out of state. Eligible businesses may receive $5,000 per employee, subject to caps and eligibility requirements. AYE
S3519 This bill redefines "following" for the Stalking in the Fourth Degree offense. "Following" would include the unauthorized tracking of a person's movements or location through the use, placement, attachment or insertion of any device or computer software, program, spyware, malware or adware that gains access to, records, tracks or reports a movement or location of a person or their property without the person's permission or authority to do so. AYE
S4776 COSPONSOR Adds falsely reporting the use of a deadly weapon or dangerous instrument as part of the crimes of falsely reporting an incident in the first and second degrees. AYE
S8021C This bill requires the Commissioner of DCJS, the Superintendent of the State Police, the Commissioner of DOCCS and the person in charge of every state law enforcement agency to adopt and implement a tattoo policy for all members of such law enforcement agency who are designated as police officer or peace officers. The policy would also apply to all applicants for employment in such positions. AYE
